1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this Promotion is deemed acceptance of these Terms and Conditions.



2. Entry is only open to residents of Australia and New Zealand. Entrants under the age of 18 years must have prior parental or legal guardian consent to enter, and further, the parent/guardian of the Entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this Promotion. Employees (and immediate families) of Bauer Media Pty Ltd, Bauer Media Group (NZ) LP and agencies associated with this Promotion are ineligible to enter.

3. The Promotion commences on 30 October 2014 and closes at 17:00pm (AEST) on 25 April 2015 (“Promotional Period”). The draw will take place on 30 April 2015 at Direct Response Australia, Unit D, 65 Reserve Road, Artarmon, NSW 2064 at 4:00pm (AEST). The Winners will be notified in writing within seven (7) business days of the draw, and by telephone using the contact details given in their entry. The Winner’s name will be published in the public notices section in The Australian on 8 May 2015. The Promoter’s decision is final and no correspondence will be entered into.

4. To be eligible to enter, individuals must purchase, during the Promotional Period, any of the following participating puzzle books containing the “$25,000 Jackpot Puzzle”:

Australian Residents: Entrants must complete the Jackpot Puzzle and then write the solution on the official coupon, found within each participating puzzle book during the Promotional Period, and then send the completed coupon with their details, including their name, address and daytime telephone number, to Puzzler $25,000 Jackpot, PO Box 2499, Sydney, NSW 2001.

New Zealand Residents: Entrants must complete the Jackpot Puzzle and then write the solution on the official coupon, found within each participating puzzle book during the Promotional Period, and then send the completed coupon with their details, including their name, address and daytime telephone number, to Puzzler $25,000 Jackpot, Private Bag 92-217, Auckland Mail Centre, Auckland, NZ.

5. Multiple entries permitted; however each entry must be submitted separately on an original coupon and in accordance with entry requirements. Each entry must be posted in a separate stamped envelope and contain an official entry coupon. Each solution must be correct in order for that entry to be valid.

6. The Promoter is neither responsible nor liable for late, lost or misdirected entries, or entries not received by the Promoter for any reason whatsoever. Original copies of entries will not be returned to the Entrant after Judging has been completed.

7. The Promoter, in its absolute discretion, reserves the right to verify the validity of entries and Entrants (including an Entrant’s identity, age and place of residence) and to disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

8. Incomplete, indecipherable or illegible entries will be deemed invalid.

9. The first (1) valid and correct entry drawn from all entries received will be deemed the major prize Winner and will win:  

  • $25,000 – awarded in the form of a cheque made in favour of the Winner

Total prize pool is valued at AU$25,000 (including GST). Prize does not include any ancillary costs associated with redeeming this prize. These are the responsibility of the Winner.

10. If necessary, an unclaimed prize draw will be held on 31 July 2015 at the same time and place as the original draw in order to distribute any unclaimed prizes, subject to any directions from a regulatory authority.  Winners, if any are required, will be notified by telephone and in writing using the contact details provided in their entry within seven (7) business days of the draw. The Winners' names will be published in the public notices section in The Australian on 6 August 2015.

11. Prize must be taken as offered. The prize, or any unused portion of the prize, is not exchangeable or cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize Winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.

12. The prize will be delivered to the nominated address of the prize Winner. Delivery of the prize is valid to any state and/or city in Australia or New Zealand.

13. If the Winner is under the age of 18 years, the prize will be awarded to the Winner’s parent or legal guardian on behalf of the Winner. It is the responsibility of the Winner’s parent/legal guardian to prove their parental status/legal guardianship at the time of Winner notification. In the event that for any reason whatsoever a person/s mistakenly represents themselves to be a Winner's parent and/or legal guardian, then that person will be liable for all costs associated with relocating and/or re-awarding the prize (including but not limited to any administrative fees incurred by the Promoter). Where relevant, the Promoter is only responsible for ensuring that the prize is awarded to a person who is either a parent or legal guardian of the Winner. The Promoter is not responsible for determining any other delivery details or taking direction that relates to any ongoing family law negotiations and/or determinations. These are the responsibility of the Winner and their respective parent/s and/or legal guardian/s.

14. In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.

15. In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the various Lottery Departments.

16Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all valid prize claims in excess of the advertised prize pool will be honoured. All advertised instant prizes will be awarded.

17. Printing and other quality control errors will not invalidate an otherwise valid prize claim. In the event of a query as to the validity of an entry, the judges will determine whether or not the entry is to be deemed valid, taking into consideration all mitigating circumstances and knowledge available to them at the time of the Judging. No correspondence will be entered into.

18. The Promoter is neither responsible nor liable for any late, lost or misdirected mail (including but not limited to prizes).

19. The Promoter is not responsible nor liable for any prize damaged in transit in the delivery of their prize.

20. Any cost associated with accessing the promotional website is the Entrant’s responsibility and is dependent on the Internet Service Provider used.

21. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including  but not limited to natural disaster), the  Promoter reserves the right, subject to reference to all relevant  state and territory rules and regulations, to cancel, terminate, modify or suspend the Promotion.

22. If a medical circumstance in some way restricts your ability to enter the Promotion through the required mechanic, you are still eligible to enter; however you must briefly state your circumstances upon entry.

23. If your entry is selected as a winning entry, validation of your circumstances/the validity of your entry will be undertaken by the Promoter. Method of validation (without limitation) will be determined by the Promoter in its complete discretion. If the winning entry is deemed to be a winner, the Winner will be notified as per the Terms and Conditions herein. In the event that the Promoter requests the Entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoter. It is a condition of accepting the prize that the Winner sign any such legal documentation.

24. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.

25. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a Winner or Entrant; or (f) use of the prize.

26. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.

27. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.

Privacy

28. The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be accessed by visiting www.bauer-media.com.au/privacy/. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Entrant. Entrants should direct any request to opt out, access, update or correct PI, to the Promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy. If a receipt is not available from the participating store where the participating title(s) were purchased, Entrants must provide an original copy of the title magazine cover as proof of purchase. Promoter reserves the right to request proof of purchase for each entry made to verify all entries before awarding the prize. Failure to produce the required valid purchase receipt or original copy of the title cover for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an Entrant's entries and forfeiture of any right to a prize. Each entry must relate to a separate qualifying purchase.

10. Prizes:

The first two (2) valid entries with the correct answer to the Tropical Hawaiian Holiday Puzzle will receive: 

  • Two (2) x return economy airfares to Honolulu, Hawaii valued at up to AU$4,745 (including taxes)
  • Seven (7) x nights' accommodation in luxurious oceanfront room at the Waikiki Beach Marriott Resort valued at up to AU$1,444
  • Two (2) x USS Missouri, Arizona Memorial and Pearl Harbor day tour valued at up to AU$180
  • Two (2) tickets to a Paradise Cove Luau valued at up to AU$178
  • AU$1,000 in form of a cheque (1 cheque per holiday)

The total prize pool is valued at up to $15,094 (including taxes) (depending on point of departure). Prize does not include any ancillary costs associated with redeeming this prize: these are the responsibility of the Winner.

11. Airfare will be from any capital city in Australia. In the event a winner is from New Zealand, flight will be from Auckland. Costs of transport to/from the capital city or Auckland airport will be responsibility of the Winner.

12. The prize must be redeemed as a package in full by 31 December 2015. Redemption of prize is subject to availability at time of booking. Prize is a single event holiday and cannot be separated into different holiday vacations.

13. In the event that the Winner is under the age of 18 years, they must be accompanied by their parent and/or legal guardian when redeeming their prize.

14. Prize does not include travel to and from the departure point or hotel/airport transfer (unless specified). These costs are the responsibility of the Winner.

15. The Winner (and their companion) are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.

16. A valid passport is required for all international journeys. All passports must be valid for six (6) months prior to departure. It the responsibility of the Winner and their travel companion to ensure they have all required travel documentation (including but not limited to passports and visas) as required for travel to the destination point. All costs associated with obtaining this travel documentation are the responsibility of the Winner. 

17. The Winner and (their companion) are responsible for obtaining all required documentation and visas to enter United States of America and Canada. If the Winner should also be a US citizen, they will require additional documentation to enter Canada. A Canadian visa may be required for non-US citizens; check your home country requirements for entering Canada. From 4 September 2010, the United States government will charge US$14 as payment for the mandatory ESTA for all individuals proposing to travel to the United States under the Visa Waiver Program. The fee is payable by credit card and it is very important to make payments through the official website. ESTA's official website is https://esta.cbp.dhs.gov/esta/. This cost is the responsibility of the Winner and their travel partner.

18. The two (2) flights must be utilised at the same time, for the same travel dates, to the same destination.

19. Transport to and from departure point, including but not limited to additional domestic airfares if required, any additional meals, any extra sightseeing or activities, any additional accommodation, personal spending money, and all other ancillary costs, as well as obtaining any of these, are the responsibility of the Winner and their travel companion. Prize also excludes medical expenses, items of a personal nature, beverages, optional tours not outlined, laundry, telephone calls, additional nights, room upgrades or other ancillary costs associated with redeeming the prize other than those specified. These costs and expenses are the responsibility of the Winner. Any extension to the duration of the prize is at the Winner's sole expense and subject to availability at the time of booking. For the removal of doubt, taxes for international/domestic travel are included in the prize-winning international/domestic airfares provided by the Promoter.

20. Each Winner (and any companion) must travel on the same dates, depart from and return to the same point of departure, and travel together. Frequent flyer points will not form part of the prize. Standard conditions for tickets and accommodation apply. The Promoter's decision is final and no correspondence will be entered into. It is each Winner's responsibility to ensure that they have all relevant documentation in order to travel. All elements of a prize must be taken together within the one trip. Winners will not be compensated for unused portions of a prize.

21. All prize items are valued inclusive of GST and the Promoter takes no responsibility for any variations in item values. All prize values are correct as of 23/04/2014. All prize values are in Australian dollars. The components of the prize may alter for reasons beyond the Promoter's control. The prize is not, nor any component thereof, transferable, exchangeable or redeemable for cash. No components of the prize can be exchanged for other travel or accommodation at other destinations. In the event that any prize item is unavailable, the Promoter reserves the right to substitute a prize item of equal or greater value. Any taxes (other than GST, if any) which may be payable as a consequence of a Winner receiving the prize are the sole responsibility of the Winner.

22. It is a condition of accepting the prize that the Winner (and any travelling companion) must comply with all the conditions of use of the prize and prize supplier's requirements.

23. It is a condition of accepting the prize that the Winner may be requested to present their credit card upon arrival at any hotel to cover all incidentals they may incur, including their stay at that hotel.

Redemption of prize at a venue is subject to the standard rules and regulations of that venue.

25. In the event that the prize, or part of the prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value.

38. By entering this Promotion, the Entrant consents to receipt of any email regarding the Promotion, and other emails which inform the Entrant of the Promoter's other publications, products, services and events, and to promote third party goods and services it may be interested in.

Coles Gift Card promotion

1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this Promotion is deemed acceptance of these Terms and Conditions.



2. Entry is only open to residents of Australia who purchase any current edition of the puzzle books stipulated in clause 4 during the Promotional Period. Entrants under the age of 18 years must have prior parental or legal guardian consent to enter. Employees (and immediate families) of Bauer Media Pty Ltd, and agencies associated with this Promotion, are ineligible to enter.

3. The Australian Puzzler Coles Gift Card Competition commences 11 September 2014 and closes at 17:00pm (AEDST) on 13 November 2014. The Judging will be done by a panel of judges appointed by the Promoter. The Judging will begin on 19 November 2014 at the Promoter’s Premises, Level 21, 66-68 Goulburn St, Sydney, NSW 2000. The Winners will be notified in writing and by telephone using the contact details given in their entry.

4. To enter, individuals must purchase Word Finder #48, Sudoku #116 or Simply Code Crackers #25 during the Promotional Period and complete the relevant competition puzzle and fill in the original entry coupon found in each issue, including their full name, address and daytime telephone number, answer to the puzzle and answer to the competition question in 25 words or fewer, ‘When you shop at Coles, what is your ultimate grocery item and why?’ and send it to: Puzzler Media Coles Gift Card Competition, PO Box 436, Eastern Suburbs MC, NSW 2004.

5. Multiple entries permitted subject to the following: (a) each entry must be posted in a separate stamped envelope and contain an official entry coupon; (b) each solution must be correct in order for that entry to be valid; (c) each answer to the competition question must be substantially unique; (d) each entry must be submitted separately on an original coupon and in accordance with entry requirements.

6. Original copies of entries will not be returned to the Entrant after Judging has been completed.

7. Incomplete, indecipherable or illegible entries will be deemed invalid.

8. This is a game of skill: chance plays no part in determining the Winner. Each valid entry will be individually judged based on the literary and creative merit of the answer to the competition question provided. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.

9. The Entrant warrants to the Promoter that the entry submitted is an original artistic work of the Entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the Entrant in relation to the entry was provided by a third party, the Entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this Promotion. The Entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.

The Promoter is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future Promoter’s or their agents' book publications, promotional, marketing and publicity purposes, without any further reference or payment or other compensation to the Entrant. The Promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.

11. Entries must not be offensive, defamatory or racist. Any entry which the judges deem inappropriate will be invalid. The Entrant agrees to indemnify the Promoter.

12. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s identity, age and place of residence) and to disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

13. The best fifteen (15) valid entries as determined by the judges will be deemed the major prize Winners and will win: 

  • One (1) x $200 Coles Gift Card. 

Total prize pool is valued at $3,000 (including GST). Any ancillary costs associated with redeeming the prize are not included. These are the responsibility of the Winner.

14. Vouchers are valid for twelve (12) months from the date of issue. Redemption of the voucher prizes are subject to the terms and conditions stipulated on the voucher. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a Winner or Entrant; or (f) use of the prize.

24. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.

25. The Promoter collects personal information (“PI”) in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be accessed by visiting www.bauer-media.com.au/privacy/. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Entrant. Entrants should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy. All entries become the property of the Promoter. Entrants’ PI will not be disclosed to any entity outside of Australia.
